PRIVACY POLICY [v2 03/2019]

[1] CREDIT CHECKS PRIVACY CONSENT

The Customer consents to InstaNode obtaining credit reports and information containing personal information (as well as information concerning commercial credit worthiness and activities) for the purpose of assessment by InstaNode of an application for credit (whether commercial or personal) or for the purpose of the collection of payments that are overdue.

InstaNode respects your privacy and is committed to maintaining strict confidentiality of the Customer. InstaNode will not reveal, sell, or in any way divulge information about the Customer or the Internet usage of the Customer to any individual, business, marketing, or research group without prior consent of the Customer or without legal warrant. The Contact Information (includes name, company name, job title and description, telephone numbers, mobile number, fax number, postal address, business address and email address), the Transactional Information (includes invoicing, billing and payment details, billing name and address, credit card details) and Other Information (includes information about your organization, requirements and similar information needed to suit our services to the Customer better) will be safeguarded with highest levels of security. InstaNode will not authorize the release of these information to anyone outside unless the Customer has consented to such disclosure.


[3] PUBLICATION AT CUSTOMERS RISK

The Customer accepts responsibility for all information and material issued by the Customer over any Service, and indemnifies InstaNode against any liability in relation thereto. In particular the Customer undertakes that it shall not publish, distribute or issue any information that is illegal, including copyrighted materials. The Customer also acknowledges that InstaNode does not vet or approve any information or material available through any service and that InstaNode does not accept any liability. To the full extent permitted by law the Customer accesses and uses such information and material at their own risk.

[4] GDPR

We are an organization that respects your privacy and your rights to own your information. As per our Privacy standards, we strictly adhere to the policies set forth by the legal framework of the General Data Protection Regulation (GDPR).

We take responsibility for providing you (the Customer) with uniform and compliant standards for personal data privacy. You have the following rights relating to your personal data under GDPR.

Right to Restrict Processing [v2 03/2019]

[5] Right to Restrict Processing

You have the right to request that we restrict processing of your personal data where there is no legitimate interest for us to do so:

  • Where the accuracy of the personal data is contested, to restrict the processing until such time as the accuracy has been sufficiently verified.
  • Where you object to the processing (See Right to Object), and where we are considering whether there are legitimate grounds to override the request.
  • When processing is unlawful and you oppose erasure and request restriction instead.
  • If we no longer need the personal data but you require the data to establish, exercise or defend a legal claim.

[6] Right of Access (Access to Information)

The GDPR Act gives you the right to access information held about you.

You can exercise this right by contacting us.

We are required to verify your identify before processing any right to access request, once verified the data shall be provided within 28 days.

The data shall be provided free of charge however an admin fee may be applied where a request is manifestly unfounded or excessive, particularly if it is repetitive.

Right to Erasure [v2 03/2019]

[7] Right to Erasure (Also known as the right to be forgotten)

As an individual you have the right to request the erasure of any data we hold on you, this is not an absolute right, for example it does not override our requirement under UK law to keep financial data such as invoice information.

You can make a request where your personal data is no longer necessary in relation to the purpose for which it was originally collected/processed, for example if you cancel all services you have with us.

[8] Right to Rectification

The GDPR provides the right to have any personal data rectified that may be incorrect or incomplete.

Customers can update their own personal details via the client area however if this is not sufficient please contact our customer services team

[9] Right to Object

You have the right to object to the processing of your personal data where there is no legitimate or lawful reason to do so.
